ARCHITECTURAL REVIEW COMMITTEE: HOA Board

THE CURRENT BOARD OF DIRECTORS IS SEEKING VOLUNTEERS TO SERVE ON A COMMITTEE TO REVIEW THE COTTONWOOD BLUFFS HOA CONTROLLING DOCUMENTS. PLEASE CONTACT THE PRESIDENT IF YOU ARE WILLING TO HELP OUT WITH THIS IMPORTANT TASK.

The post of secretary-treasure has been vacant for approximately 2 of last 3 years. Excessive changes in regulation and oversight from the state has created an inordinate time commitment for volunteer positions. Therefore, the Cottonwood Bluffs HOA Board of Directors has presented a budget with funding to hire an HOA Management Company beginning in the year 2025. It is the Board's believe this will streamline the process of keeping on task and provide much needed expertise and ability to pay dues online, architectural review, oversee the quality of property maintenance and compliance with our governing documents, regular accounting reports, board educational updates, and innovative encouragement for membership involvement. It is notable that 80% of all Colorado HOAs employ a Management Company. But it comes at a cost and dues need to be raised.
The Board of Directors has also decided it is in the best interest of the community to engage a law firm with expertise in community law to revise and amend, or rewrite, our Covenants, By-Laws, and Policies with updates pursuant to the numerous Colorado State Legislature Laws being passed concerning HOAs since our last legal review in 2016. In 2024 alone there were 24 legislative actions effecting HOAs. Our governing documents are seriously in a state of non-compliance and need to be reviewed by legal counsel and brought before the members for ratification.

ARCHITECTURAL REVIEW COMMITTEE: As per the covenants, contact the architectural review committee before making any improvements or changes to buildings or landscaping. Due to lack of homeowner participation the board has been acting as Architectural Review Committee for many years now. You can contact the committee at cottonwoodbluffshoa@gmail.com. FROM 2017 ANUAL MEETING MINUTES:
In other new business was the attorney’s suggestion at the special July 21,2016 meeting to grandfather in designs, fences and landscapes that are in violation of the original covenants. The main concern is that the 6 feet privacy fences appear to be in violation of the original HOA covenants. John Morris reported that early on when the control of the property was passed from the builder to the HOA it was approved that these fences could be 6 feet and on each property if they are behind the front of the property closest to the road. There was a motion by John Morris to
grandfather in all properties. There was a second by Naomi Cackler. It was voted and approved to
grandfather in all property designs, landscape, and fences as they exist April 27, 2017.
